Se trata de una de las soluciones que se suelen poner encima de la mesa cuando un negocio no pasa por un buen momento. Como <strong>abogado en Tenerife<\/strong> he asesorado a muchas empresas sobre esta cuesti\u00f3n. Es importante tener claro desde el primer momento que no todas las que se presentan a un concurso de acreedores alcanzan una soluci\u00f3n, algunas acabar\u00e1n en la fase de liquidaci\u00f3n.<\/p>\n<p><!--more--><\/p>\n<h2>Qu\u00e9 es el concurso de acreedores<\/h2>\n<p>El concurso de acreedores es un procedimiento judicial que sirve para paralizar las deudas, ejecuciones y embargos. Se trata de un mecanismo que permite organizar los pagos a los acreedores o salvar la situaci\u00f3n de insolvencia si existe. Obviamente, la finalidad \u00faltima es <strong>tratar de lograr la continuidad de la empresa<\/strong>. Lo que busca el concurso de acreedores es conseguir un convenio que intente que el negocio vuelva\u00a0 a ser viable. Aunque es cierto que el porcentaje de logros suele ser muy peque\u00f1o.<\/p>\n<p>La insolvencia puede deberse a un exceso de deudas, a la falta de liquidez o a una minusvaloraci\u00f3n de los activos. Podemos hablar de <strong>insolvencia inminente<\/strong>, en la que la empresa prev\u00e9 que no va a ser capaz de cumplir con sus obligaciones. O de <strong>insolvencia actual<\/strong>, en la que el deudor ya no puede pagar a los acreedores. En este \u00faltimo caso, existe la obligaci\u00f3n legal de presentar la solicitud de concurso de acreedores en un plazo de dos meses.<\/p>\n<p>Si no es posible llegar a un acuerdo con los acreedores es la <strong>Ley Concursal<\/strong> la encargada de proporcionar el procedimiento a seguir para liquidar el activo de un modo ordenado y repartir despu\u00e9s el resultado entre los acreedores.<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-1223\" src=\"https:\/\/ffbethencourt.es\/wp-content\/uploads\/2021\/02\/abogado_tenerife_1-1-scaled-1.jpg\" alt=\"Qu\u00e9 ventajas tiene el concurso de acreedores\" width=\"2560\" height=\"1707\" srcset=\"https:\/\/ffbethencourt.es\/wp-content\/uploads\/2021\/02\/abogado_tenerife_1-1-scaled-1.jpg 2560w, https:\/\/ffbethencourt.es\/wp-content\/uploads\/2021\/02\/abogado_tenerife_1-1-scaled-1-300x200.jpg 300w, https:\/\/ffbethencourt.es\/wp-content\/uploads\/2021\/02\/abogado_tenerife_1-1-scaled-1-1024x683.jpg 1024w, https:\/\/ffbethencourt.es\/wp-content\/uploads\/2021\/02\/abogado_tenerife_1-1-scaled-1-768x512.jpg 768w, https:\/\/ffbethencourt.es\/wp-content\/uploads\/2021\/02\/abogado_tenerife_1-1-scaled-1-1536x1024.jpg 1536w, https:\/\/ffbethencourt.es\/wp-content\/uploads\/2021\/02\/abogado_tenerife_1-1-scaled-1-2048x1366.jpg 2048w, https:\/\/ffbethencourt.es\/wp-content\/uploads\/2021\/02\/abogado_tenerife_1-1-scaled-1-18x12.jpg 18w\" sizes=\"(max-width: 2560px) 100vw, 2560px\" \/><\/p>\n<h2>Qu\u00e9 ventajas tiene el concurso de acreedores<\/h2>\n<p>Una de las ventajas \u00a0que ofrece el concurso de acreedores es que el administrador del negocio sigue<strong> manteniendo la capacidad de tomar las decisiones<\/strong> de administraci\u00f3n y de disposici\u00f3n de su patrimonio, siempre y cuando cuente con la aprobaci\u00f3n del administrador concursal. No tienen la obligaci\u00f3n de hacer frente a las deudas con su patrimonio personal. Adem\u00e1s, es un procedimiento que puede ser llevado a cabo por todo tipo de empresas independientemente de su tama\u00f1o.<\/p>\n<p>En el caso de que la empresa asuma que su continuidad ya no es viable <strong>puede pasar del convenio a la liquidaci\u00f3n.<\/strong> El concurso es un buen m\u00e9todo para renegociar las deudas, dado que se pueden llegar a conseguir reducciones de hasta el 50 %, lo que favorece la liquidez de la empresa. Tambi\u00e9n supone la paralizaci\u00f3n de las ejecuciones iniciadas por los acreedores. Del mismo modo, la Seguridad Social y la Agencia Tributaria tampoco podr\u00e1n plantear procedimientos de apremio a la empresa.<\/p>\n<p>Esta figura legal frena la ejecuci\u00f3n de aquellos bienes sobre los que se haya constituido una hipoteca o cualquier otra garant\u00eda real y sean necesarios para la continuidad de la actividad empresarial. Tambi\u00e9n se para el devengo de los intereses que sean generados por los cr\u00e9ditos hasta que se finalice el concurso de acreedores.<\/p>\n<p>El responsable de la empresa est\u00e1 <strong>obligado a solicitar el concurso de acreedores<\/strong> cuando no puede, o prev\u00e9 que no vaya a poder en el futuro, pagar sus obligaciones. Los requisitos espec\u00edficos se establecen en la Ley Concursal y es cierto que no todas las firmas pueden acogerse a este procedimiento. Se ha de presentar ante el Juzgado de lo Mercantil.<\/p>\n<p>Si no es un \u00abconcurso voluntario\u00bb, que parta de la propia empresa, puede solicitarlo un acreedor de la misma. Cuenta con un plazo de dos meses tras saber que no va a poder cumplir con sus obligaciones. Y este es el que se conoce como <strong>\u00abconcurso necesario\u201d<\/strong>. En este caso las consecuencias son m\u00e1s negativas para la empresa, ya que sus responsables pierden la capacidad de administraci\u00f3n y gesti\u00f3n.<\/p>\n<p>La Ley Concursal establece un periodo de tres meses durante el que la empresa puede negociar un convenio con sus acreedores o una propuesta de refinanciaci\u00f3n.
